1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of The Auscyclopedia website (auscyclopedia.app) and mobile applications (the "Service"), provided by Dennis Perrin ("we," "us," "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
The Auscyclopedia is a free educational and entertainment guide to Australian language, etiquette, and culture, intended for non-Australian travellers and the curious. The Service is provided "as is" — see Section 8 (Disclaimers).
3. Eligibility
You must be at least 17 years old to use the Service. The Service contains vulgar language, including profanity, that is unsuitable for younger users. By using the Service, you represent that you meet this age requirement.
4. Acceptable use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorised access to our systems or other users' data
- Scrape, copy, or reproduce substantial portions of the content for commercial purposes without permission
- Reverse-engineer, decompile, or disassemble the mobile applications
- Use the Service to transmit malicious code, viruses, or harmful data
- Interfere with the proper functioning of the Service
- Misrepresent your affiliation with us, including in advertising or sponsorship contexts
- Impersonate another person
We reserve the right to suspend or terminate access for users who violate these terms.
5. Intellectual property
5.1 Our content
All content within the Service — including text, graphics, logos, dictionary entries, etiquette explainers, communication scenarios, code, design, and the trade name "The Auscyclopedia" — is owned by us or our licensors, and is protected by Australian and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes. This licence does not transfer any ownership rights to you.
5.2 Permitted use
You may:
- Read, search, and browse the content for personal use
- Share specific entries via the share buttons provided
- Quote brief excerpts (under 150 words) with proper attribution
- Link to specific pages on auscyclopedia.app
You may not:
- Reproduce substantial portions of the content elsewhere
- Use the content to train AI or machine learning models without permission
- Republish the content under your own name or brand
- Use the trade name or logo without written permission
5.3 Indigenous content
Where the Service references words, place names, or cultural practices originating with Aboriginal and Torres Strait Islander peoples, we attribute these respectfully. The Service does not transfer any rights in Indigenous cultural and intellectual property.
6. Vulgar language advisory
The Service contains words and phrases that are crude, profane, or sexually-suggestive in some contexts. These are presented in their authentic linguistic context as part of an educational guide to how Australians actually speak. The Service is rated 17+ on App Store and Mature 17+ on Play Store accordingly.
Users may toggle a "filter strong language" setting in the Service's preferences to obscure flagged content.
The Service is not intended to offend any individual or group. If you find specific content offensive, you may close the application; you may also email us at d.perrin@live.ca with a specific concern, and we will consider it in good faith.
7. Advertising and affiliate disclosures
The Service is supported by:
- Programmatic advertising (Google AdSense, Google AdMob, and similar networks)
- Direct-sold sponsorships from Australian businesses, marked as "Sponsored" or "Presented by"
- Affiliate links to third-party services such as Booking.com, GetYourGuide, Klook, Skyscanner, Wise, and Airalo. When you click an affiliate link and complete a transaction, we may receive a commission at no additional cost to you.
We disclose all sponsored content clearly. Our editorial recommendations are made independently of advertising relationships.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:
- Accuracy or completeness of content
- Merchantability or fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
The content is for educational and entertainment purposes only. It is not professional advice. Australian language, customs, and etiquette vary by region, generation, and context — what is appropriate in one situation may be inappropriate in another. Use the content with judgment.
To the maximum extent permitted by law, we disclaim all warranties.
9. Limitation of liability
To the maximum extent permitted by law, in no event will we, our directors, employees, agents, or affiliates be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages arising from your use of or inability to use the Service
- Damages arising from third-party services accessed through the Service (including affiliate partners)
Our total liability for any claim arising out of or related to these Terms or the Service is limited to AUD $100 or the amount you paid us in the 12 months prior to the claim, whichever is greater.
10. Indemnification
You agree to indemnify and hold us harmless from any claim, damage, liability, loss, or expense (including reasonable legal fees) arising out of or related to:
- Your violation of these Terms
- Your violation of applicable laws
- Your misuse of the Service
- Your infringement of any third party's rights through your use of the Service
11. Third-party services
The Service may include links to third-party websites or services not owned or controlled by us. We are not responsible for their content, privacy policies, or practices. Your interactions with third-party services are solely between you and them.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time.
Upon termination, the rights and licences granted to you under these Terms cease, but provisions that by their nature should survive (such as intellectual property, disclaimers, limitations of liability, and governing law) will remain in effect.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on auscyclopedia.app with a new effective date. For material changes, we will provide additional notice.
Your continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing law and dispute resolution
These Terms are governed by the laws of [GOVERNING STATE], Australia, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms will be resolved in the courts of [GOVERNING STATE], Australia, except that we may seek injunctive relief in any jurisdiction.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protections, those protections still apply.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
16. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
